1. Scope

The following Terms and Conditions (T&Cs) apply to all orders placed through our online shop by consumers and entrepreneurs.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity. An entrepreneur is a natural or legal person, or a legally capable partnership, who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

In relation to entrepreneurs: If the entrepreneur uses conflicting or additional general terms and conditions, their validity is hereby objected to; they will only become part of the contract if we have explicitly agreed.

2. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with Advanced Food AG.

The presentation of products in the online shop does not constitute a legally binding offer but an online catalog without obligation. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction options provided and explained in the ordering process. By clicking the order button, you submit a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after submission.

The contract is concluded depending on the payment method chosen:

Advance payment (prepayment)
We accept your order by sending a separate e-mail confirmation within two days, in which we provide our bank details.

PayPal, PayPal Express
During the order process, you will be redirected to the PayPal website. There you can enter your payment data and confirm the payment instruction to PayPal. After submitting the order in the shop, we instruct PayPal to initiate the payment transaction and thereby accept your offer.

3. Contract Language, Storage of Contract Text

The language available for concluding the contract is German.

We store the contract text and send you the order data and our T&Cs in text form. For security reasons, the contract text is no longer accessible via the Internet.

4. Delivery Conditions

In addition to the indicated product prices, shipping costs will be added. Details on shipping costs can be found in the respective product offers.

We only deliver via shipping. Self-collection of goods is not possible.

We do not deliver to parcel stations.

5. Payment

The following payment methods are generally available in our shop:

Advance payment (prepayment)
If you select advance payment, we will provide our bank details in a separate e-mail, and the goods will be delivered after receipt of payment.

PayPal, PayPal Express
During the ordering process, you will be redirected to PayPal. To pay via PayPal, you must be registered there and log in with your credentials to authorize the payment instruction to us. After submitting the order, we instruct PayPal to initiate the payment transaction, which is automatically executed immediately by PayPal. Further information is provided during the ordering process.

6. Right of Withdrawal

Consumers have the statutory right of withdrawal as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7. Retention of Title

The goods remain our property until full payment has been made.
For entrepreneurs: We retain ownership of the goods until all claims arising from an ongoing business relationship have been fully settled. You are entitled to resell the reserved goods in the ordinary course of business; all claims arising from this resale are hereby assigned to us in advance up to the invoice amount, and we accept this assignment. You remain authorized to collect these claims; however, we may collect them ourselves if you fail to meet your payment obligations.

8. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay. Failure to do so does not affect your statutory claims and their enforcement, especially warranty rights, but it helps us assert our claims against the carrier or transport insurance.

For entrepreneurs: The risk of accidental loss or deterioration passes to you as soon as we hand over the goods to the carrier, freight forwarder, or other person or institution responsible for the shipment. For merchants, the examination and notification obligations under § 377 HGB apply. Failure to give notice will be considered approval of the goods unless the defect was not detectable upon inspection. This does not apply if we fraudulently concealed a defect.

9. Warranty and Guarantees

Unless expressly agreed otherwise below, statutory warranty law applies.

For consumers purchasing used goods: claims for defects are excluded if the defect occurs after one year from delivery. Defects occurring within one year can be asserted within the statutory limitation period of two years from delivery.

For entrepreneurs: the limitation period for warranty claims for newly manufactured goods is one year from the transfer of risk. The sale of used goods is excluded from any warranty. Statutory limitation periods for recourse claims under § 445a BGB remain unaffected.

For entrepreneurs, only our own product descriptions and the manufacturer’s product information included in the contract constitute agreements on the quality of goods; we do not assume liability for public statements by the manufacturer or other advertising statements.

If the delivered item is defective, we will, at our discretion, either remedy the defect (rectification) or deliver a non-defective item (replacement).

The above limitations and shortened deadlines do not apply to claims for damages caused by us, our legal representatives, or agents:

  • in cases of injury to life, body, or health

  • in cases of intentional or grossly negligent breach of duty or fraud

  • in the event of breach of essential contractual obligations (cardinal duties)

  • under a warranty promise, if agreed

  • to the extent provided by the Product Liability Act.

10. Liability

We are always fully liable for damages caused by us, our legal representatives, or agents:

  • in cases of injury to life, body, or health

  • in cases of intentional or grossly negligent breach of duty

  • under warranty promises, if agreed

  • to the extent provided by the Product Liability Act.

In case of minor negligence in breaching essential contractual obligations (cardinal duties), liability is limited to foreseeable, typical damages. Otherwise, claims for damages are excluded.

11. Dispute Resolution

. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Youth Protection

If your order includes goods subject to age restrictions, we ensure, using a reliable process including personal identity and age verification, that the purchaser meets the minimum age requirement. The carrier will only hand over the goods to the purchaser personally after successful age verification.

13. Final Provisions

If you are an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant within the meaning of the German Commercial Code, a public law entity, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
